Terms of Service

The rules for using Workframe: your account and content, jobs and hiring, plans and payment, and what we are and aren't responsible for.

1. Agreeing to these terms

These Terms of Service are an agreement between you and Workframe ("we", "us"). They apply when you visit workframe.studio, create an account or use any part of the service. If you use Workframe for a business, studio or agency, you confirm that you can accept these terms for it.

By creating an account or using Workframe you accept these terms and our Privacy Policy. If you don't accept them, please don't use the service.

2. Who can use Workframe

  • You must be 18 or older, or the age of majority where you live.
  • You must give accurate information when you sign up and keep it up to date.
  • You choose an account type when you join: creative (freelancer, studio or agency) or hirer. Creatives show their work and apply for jobs. Hirers browse talent and post jobs.

3. Your account

You are responsible for what happens on your account. Keep your password safe, don't share it, and tell us straight away if you think someone else has used your account. We are not responsible for losses caused by someone using your account before you told us.

4. What Workframe is, and what it isn't

Workframe is a platform. It lets creatives show their work, run parts of their business, and connect with hirers, and it lets hirers find and hire creatives.

We are not an employer, agent or broker, and we are not a party to any agreement between a creative and a hirer. When you agree work with someone, that agreement is between the two of you. We don't guarantee that any job will be filled, any work will be done well, or any payment will be made.

5. Your content

Your content is everything you upload or write on Workframe: your profile, projects, images, video links, services, jobs, applications, messages and so on.

  • You own your content. We don't claim ownership of it.
  • You give us a non-exclusive, worldwide licence to store, display, format and distribute your content as needed to run Workframe, for example to show your projects on your public profile and in the directory. This licence ends when you delete the content or your account, except for copies in backups and anything that others have already shared.
  • You promise that you have the right to post your content and that it doesn't break anyone's rights or the law. If you post work made for a client, make sure you are allowed to show it.
  • Videos you add are embedded from YouTube or Vimeo. They stay on those services and are governed by their terms.

6. Acceptable use

Please don't use Workframe to:

  • post anything illegal, or anything that infringes someone's copyright, trademark or privacy;
  • post content that is hateful, threatening, harassing, sexually exploitative or defamatory;
  • pretend to be someone else, or show work that isn't yours as if it were;
  • post fake or misleading jobs, ask creatives to pay to get work, or run scams;
  • send spam, or use other people's contact details, including those of applicants, for anything other than the job they applied for;
  • scrape the site, or attack, overload or try to break into our systems;
  • get around limits or protections, for example the plan limits or the rules that keep Pro features for Pro accounts.

We may remove content and suspend or close accounts that break these rules.

7. Jobs and hiring

  • Hirers must post real jobs, describe them honestly and treat applicants fairly. If you agree to pay a fee, pay it as agreed.
  • Creatives must apply honestly and only with work they can really do.
  • Payment for work is arranged directly between hirer and creative. Workframe doesn't hold or process it.
  • Take care. Check who you are dealing with, agree the scope, price and timing in writing before you start, and never pay someone to get a job. Tell us about anything that looks like a scam.

8. Invoices, contracts, questionnaires and other business tools

The invoice, contract and questionnaire tools help you prepare documents, ask a client questions and send them a link. They are tools, not legal, tax or accounting advice. You are responsible for what your documents and questions say, for getting advice if you need it, and for meeting your own legal and tax duties, including keeping your TPIN details and records correct.

A client can sign a contract on Workframe by typing their name. Whether that signature is binding depends on the law that applies to you and your client. Documents and questionnaire links you send can be opened by anyone with the link, so send them only to the people meant to see them.

9. Plans, prices and payment

  • Workframe has a Free plan and a paid Pro plan. What each includes, and the prices, are shown on our Pricing page. Prices are in Zambian Kwacha.
  • Pro is charged monthly. We arrange payment with you directly. Your account is upgraded once payment is confirmed.
  • You can cancel Pro at any time. You keep Pro until the end of the month you have paid for. Fees you have already paid are not refunded, unless the law requires it or we tell you otherwise when you buy.
  • For hirers, the Urgent package is a one-off fee per urgent job. It covers priority placement and support and doesn't include any fee you agree with a creative. It will be offered as we roll it out.
  • We may change our prices or plans. We will give you notice before a change reaches you, and you can cancel before it does.

10. Our rights

Workframe, including its software, design, name and logo, belongs to us or our licensors. These terms don't give you any right to it beyond using the service as described. If you send us ideas or feedback, we may use them without owing you anything.

11. Reporting content and copyright complaints

If you see content that breaks these terms, or you believe something on Workframe infringes your copyright, write to hello@workframe.art. For a copyright complaint, please tell us:

  • what work you own, and how to identify it;
  • the address (URL) of the page where the content appears;
  • that you are the owner or act for the owner, and that you believe the use is not allowed;
  • your name and how to reach you.

We will review reports and may remove content or contact the person who posted it.

12. Suspending and ending your account

You can stop using Workframe and delete your account at any time. We may suspend or close an account, with or without notice, if it breaks these terms, puts others at risk, or if the law requires it. If we close your account without a good reason, we will refund any Pro fee for the time you did not get.

When an account is closed, your right to use the service ends and your content is deleted as described in our Privacy Policy. Sections that should continue to apply, such as ownership, disclaimers and limits on our liability, continue to apply.

13. No guarantees

Workframe is provided "as is" and "as available". We work to keep it running and secure, but we can't promise it will always be available, error-free or free of harmful content, and we don't promise that you will win work, find talent or be paid.

We are not responsible for content posted by users, for the conduct of users, or for anything that happens between users, online or offline.

14. Limits on our liability

To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, lost work, lost data or damage to reputation arising from your use of Workframe.

Our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim and K500. Nothing in these terms limits liability that cannot be limited by law.

15. Your responsibility for claims

If a claim is made against us because of your content, your misuse of Workframe or your breach of these terms, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.

16. Changes to the service and these terms

We may change or stop parts of Workframe, and we may update these terms. We will change the date at the top and, for important changes, give you notice before they apply. If you keep using Workframe after a change takes effect, you accept the new terms.

17. Governing law

These terms are governed by the laws of Zambia. We hope to settle any disagreement with you informally first. If we can't, the courts of Zambia will decide it.

18. General

These terms and our Privacy Policy are the whole agreement between you and us about Workframe. If part of them can't be enforced, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to. You can't transfer your account or your rights under these terms to anyone else without our consent.
